Guarantees for Documentary Letters of Credit Issued by Foreign Banking Institutions
Guarantees for documentary letters of credit issued by foreign banking institutions constitute a specialised risk-mitigation framework. Under this facility, the Export Credit Insurance Corporation (KUKE) offers comprehensive guarantees to financial institutions confirming, discounting or post-financing letters of credit, thereby securing the recovery of their contractually entitled receivables.
By leveraging KUKE's guarantee instruments and transferring the underlying transactional risk, commercial banks can continuously facilitate and expand their clients' international trade and export portfolios.
This solution substantially mitigates institutional risk exposure associated with short-term trade financing and provides the capacity to extend sovereign-backed coverage for up to 100% of the bank's secured accounts receivable.
Foundational Covenants and Conditions of Cooperation
Insurance protection encompasses an expansive roster of international jurisdictions, expressly excluding member states of the European Union, Australia, Canada, Iceland, Japan, New Zealand, Norway, Switzerland and the United States of America.
The guarantee provides full indemnity for financial losses sustained by the beneficiary resulting from a contractual default by the debtor on the maturity date stipulated within the terms of the letter of credit or the post-financing agreement. This coverage is triggered provided that the non-payment is directly triggered by the realisation of either commercial or political risk.
The credit facility extended by the financial institution to the importer's bank for the settlement of obligations derived from the letter of credit shall not exceed a maximum maturity profile of two years. In the case of agricultural commodities, pursuant to the World Trade Organization (WTO) classification standards, the maximum permissible deferred payment term is strictly limited to 540 days.
Eligible beneficiaries of the letters of credit encompass not only domestic exporters but also their legally established foreign subsidiaries and international affiliates.
