The Capital Expenditure Facility with an InvestEU Guarantee Framework constitutes a specialised financial instrument designed to fund capital investments in tangible fixed assets as well as intangible assets and legal rights. The underlying credit facility is structurally secured by an InvestEU portfolio guarantee, the comprehensive underwriting costs of which are fully sustained by the Industrial Development Agency (Agencja Rozwoju Przemysłu S.A. / ARP S.A.).

This financing mechanism is specifically engineered to support small and medium-sized enterprises (SMEs) that experience restricted access to capital markets due to an absolute or temporary inability to establish conventional collateral sufficient to secure the amortisation of borrowed funds.

Credit facilities extended under this European Union scheme qualify for a repayment guarantee covering up to eighty percent of the aggregate principal volume, with all associated guarantee fees subsidised and borne exclusively by ARP S.A.

Foundational Parameters and Covenants

The permissible financing quantum shall range from a minimum of PLN 800,000 to a maximum threshold of PLN 8,593,600.

The maximum duration of the credit facility shall span up to fourteen years, provided that the formal amortisation period does not exceed a strict maturity constraint of twelve years.

The variable interest rate is structured upon the WIBOR 1M reference rate plus a commercial margin determined in strict accordance with the standardised pricing matrix utilised within the loan parameterisation system, subject to a concessionary reduction of 0.5 percentage points.

  • An InvestEU portfolio guarantee covering up to fifty percent of the total facility volume, supplemented by a first-demand mortgage on real property or a registered pledge on tangible fixed assets up to sixty percent of the loan value.
  • An InvestEU portfolio guarantee covering up to eighty percent of the total facility volume, supplemented by a first-demand mortgage on real property or a registered pledge on tangible fixed assets up to sixty percent of the loan value, restricted exclusively to commercial enterprises operating within Just Transition and Cohesion Regions.
  • A formalised notarial declaration of submission to enforcement proceedings pursuant to Article 777 of the Polish Code of Civil Procedure (Kodeks postępowania cywilnego), alongside an irrevocable power of attorney over the borrower's designated banking accounts.

Participation is restricted to commercial enterprises generating gross annual revenues in excess of PLN 4 million, possessing two fully concluded fiscal years and maintaining comprehensive accounting records (pełna księgowość).

A structured moratorium on principal repayment is contractually provided for the explicit duration of the investment execution phase.

  • Arrangement Fee: Assessed from a baseline of 0.2% of the facility volume;
  • Application & Commitment Fees: Absolute waiver of fees regarding both formal application underwriting and any unutilised, undisbursed credit tranches;

  • Early Amortisation Premium: Reduced prepayment commission limited to a maximum of 0.2% of the principal volume being amortised; absolute waiver of prepayment penalties in scenarios where early repayment is executed utilising the borrower’s autonomous internal capital reserves;

    The aggregate premium expenses derived from the InvestEU guarantee are sustained entirely by ARP S.A.

We wszystkich sprawach dotyczących przetwarzania Pani/Pana danych osobowych i przysługujących praw z tym związanych, można skontaktować się z Administratorem poprzez adres email [email protected], telefonicznie pod numerem 800 800 120 lub +48 22 703 43 00 lub pisemnie na adres siedziby Administratora wskazany w punkcie 1 powyżej.
  3. Pani/Pana dane osobowe mogą być przetwarzane do celów reklamacyjnych przez okres nie dłuższy niż rok od momentu utrwalenia danych, lub dłużej – wyłącznie w przypadkach przewidzianych przepisami prawa.
  4. Pani/Pana dane osobowe mogą być udostępnione innym podmiotom uprawnionym na podstawie powszechnie obowiązującego prawa. Pani/Pana dane mogą być także przekazywane podmiotom przetwarzającym dane osobowe na zlecenie Administratora, – przy czym takie podmioty przetwarzają dane na podstawie umowy z Administratorem i wyłącznie zgodnie z poleceniami Administratora.
  5. Pani/Pana dane osobowe nie będą przekazywane do odbiorców znajdujących się w państwach poza Europejskim Obszarem Gospodarczym
  6. Przysługują Pani/Panu następujące prawa:
    • prawo dostępu do danych osobowych oraz prawo żądania ich sprostowania, sprzeciwu wobec przetwarzania, ich usunięcia lub ograniczenia ich przetwarzania;
    • prawo wycofania zgody; wycofanie zgody nie ma wpływu na zgodność z prawem przetwarzania, którego dokonano na podstawie zgody przed jej wycofaniem;
    • prawo do przenoszenia danych osobowych, tj. do otrzymania od Administratora danych osobowych, w ustrukturyzowanym, powszechnie używanym formacie nadającym się do odczytu maszynowego (o ile ma to zastosowanie), w celu ewentualnego przekazania tych danych innemu administratorowi danych;
    • prawo do wniesienia skargi do organu nadzorczego zajmującego się ochroną danych osobowych, gdy uzna Pani/Pana, iż przetwarzanie danych osobowych dotyczących Pana/Pani osoby narusza przepisy Rozporządzenie Parlamentu Europejskiego i Rady z dnia 27 kwietnia 2016 r. w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 95/46/WE (Dz. Urz. UE L 119 z 4.05.2016) (RODO).
  7. W celu skorzystania z powyższych praw należy skontaktować się z Administratorem danych. Dane kontaktowe wskazane są w punkcie 2 wyżej.
  8. Podanie danych osobowych jest dobrowolne, niemniej jest niezbędne do nawiązania kontaktu i udzielenie odpowiedzi na zadane pytania.
  9. W związku z przetwarzaniem danych osobowych, decyzje dotyczące Pani/Pana osoby nie będą podejmowane w sposób zautomatyzowany (bez wpływu człowieka).
